Therapy Agreement

These are the terms under which any Therapist will provide services to you. Your Therapist may vary or provide additional terms of their own. If they do so, then these terms apply as far as possible.

  1. Definitions

In this agreement:

‘Booking’means an offer by you to reserve a Session at a particular time and date.
‘Session’means a discrete period of time during which a Therapist provides their services to you, whether face to face at a practice address or remotely using video-conferencing software.
‘Therapist’means any therapist, counsellor, psychotherapist, clinical psychologist or other person who uses the Website to advertise their services, whether working for us or for themselves independently.
‘we’, ‘our’ and ‘us’are references to Pinoy Therapy, a trading name of Isipan Limited, company number 14859935, whose registered office address is 128 City Road, London, United Kingdom EC1V 2NX.
‘Website’means our website at pinoytherapy.com and any other software or web pages controlled by us that provide functionality for that website.
‘Young Person’means someone between the ages of 16 and 18 years.

  1. Nature of therapy
    1. Therapy provides an opportunity to explore personal and relational issues confidentially and safely. The role of your Therapist is to facilitate this exploration without judgement. Your Therapist may also suggest exercises to practice between Sessions to help you meet the goals you set together.
    2. You acknowledge that therapy can only be effective if the person or people attending consent to participating freely and voluntarily.
    3. Your Therapist does not offer emergency support. If you are in danger, please contact your local emergency services.
  2. Sessions
    1. The start time, duration and instructions for joining a Session will be confirmed to you by us when you book it.
    2. Unless otherwise advertised, all Sessions are 50 minutes in duration.
    3. Although Sessions are carried out remotely, you agree that you will participate in a Session as if you were face to face with your Therapist in their practice.
    4. When you attend a Session, we ask that you: are located in a private room or place where confidentiality can be assured; ensure that you cannot be distracted by anything external to the Session, including family members, friends, televisions, mobile telephones or other devices; are fully dressed; refrain from eating, drinking, smoking, or chewing; are not under the influence of alcohol or any other non-prescription drugs.
    5. You should ensure that you are online, in the virtual waiting room, at least 5 minutes before the start time.
    6. Each Session will end at the agreed time. If you arrive to the Session late, then your Therapist will be available for the scheduled duration of the Session, but not necessarily after the agreed Session period has ended.
    7. The number of Sessions required to achieve a particular goal depends on many factors and so any estimate of the time you may require to achieve a goal is only that.
  3. Price and payment
    1. The price for a Session is set out on the Website and is payable when you make payment for a Booking.
    2. We shall never take payment from you automatically.
  4. Acceptance of your Booking
    1. We shall confirm your Therapist’s acceptance of your Booking by sending you an e-mail message.
    2. The start time, duration and details for joining the Session will be confirmed to you in that message.
  5. Recurring Sessions
    1. If you arrange with your Therapist, they will schedule Sessions to take place at the same time at a recurring interval. For example, they may schedule a Session starting at 10:00 every Tuesday morning.
    2. You may cancel recurring Sessions either by telling your Therapist, using the Website or by sending an email message to [email protected].
    3. If your Therapist schedules a Session on your behalf, then 48 and 36 hours before the Session starts, we shall send you an email message that contains a link to a payment page.
    4. Until you make payment, your Booking is unconfirmed and not accepted.
  6. Rescheduling a Session
    1. Through the Website, you may reschedule a Session for a different time or day
  7. Cancellation and refunds
    1. You may cancel a Booking for a Session at any time, including by not attending.
    2. If you wish to take a planned break, for example if you are going on holiday and will not be able to attend a Session for which you have already made a Booking, then you must cancel or reschedule the relevant Sessions at least 24 hours in advance through the Website.
    3. You can ask your Therapist to cancel any Sessions for which you have not made payment.

The following terms apply if you live in the UK or an EU country:
    4. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you have the right to cancel a contract within 14 days of making it and to receive a full refund, provided that you have not asked for work to start.
    5. When you make a Booking, you instruct your Therapist to start preparatory work at least 24 hours before the Session starts and you acknowledge that you understand that by doing so, you forfeit your right to the statutory cancellation period.

The following terms apply, regardless of where you live:
    6. You agree that if you do not give notice of cancellation at least 24 hours before the start of the Session then neither we nor your therapist have any obligation to refund the payment relating to that Session to you.
    7. In cases of emergency or where you reschedule the Session, your Therapist may at their absolute discretion agree to refund you or attribute your payment to a different future Session.
    8. We or your Therapist may cancel a Booking for a Session at any time before the Session starts without providing a reason. If we or they do so within 24 hours of the start of a Session for which you have already paid then we shall refund you for that Session.
    9. We or your Therapist may end a Session at any time during it, if we or they believe that your behaviour is, in any way and at their complete discretion, offensive or harmful to any person.
    10. If your Therapist has reason to believe that during a Session you may be under the influence of alcohol or non-prescription drugs then they may end a Session at any time.
  8. Ending therapy
    1. Either you or your Therapist may end your therapy relationship at any time without giving any reason. Without regard to why you wish to end the relationship, you agree to pay us in full for all Sessions that have taken place and that will take place in the following 24 hours.
    2. You may cancel Sessions that you no longer wish to attend through the Website.
    3. Despite the therapy relationship ending, all the terms of this agreement that are intended to continue afterwards, shall do so.
  9. Confidentiality
    1. You acknowledge that you understand that except as described in our privacy notice, for example where your Therapist believes that there is a safeguarding issue, or in the case of supervision (as mentioned below) everything that is discussed during a Session remains strictly confidential between you and your Therapist and will not be disclosed to any other person, including to us and to your family members.
    2. From time to time, your Therapist may consult or discuss client matters with an experienced member of their professional association. Such supervision aims to ensure that members of a professional association adhere to that organisation’s quality standards. A supervisor will never be present in any Session. If your circumstances are discussed with a supervisor, your Therapist will ensure that your identity and the identity of anyone you have mentioned is anonymised or pseudonymised. Everything discussed with a supervisor remains confidential between that person and your Therapist.
  10. Young persons
    1. A Therapist will only provide therapeutic services to a person if they are over 16 years of age.

If a Therapist provides their services to a Young Person then the following terms apply:
    2. This agreement is made between the Therapist and you as the person with parental responsibility for that Young Person.
    3. You accept responsibility for the Young Person complying with the terms of this agreement, as if these terms applied to them.
    4. You accept responsibility for every aspect of the Young Person’s behaviour during a Session.
    5. You will ensure that you are available to accept a telephone call at all times in case of emergency.
    6. In the event of an emergency, the Therapist is under no obligation to take any particular action but in the event of doubt, they will contact a medical professional or the police.
  11. Complaints
    1. If you are frustrated or dissatisfied about the therapeutic service you have received then you should first talk to your Therapist.
    2. If you have a complaint about your Therapist’s conduct that you have been unable to resolve to your satisfaction or that you believe is so serious as not to talk to your Therapist first, you may make it directly to the Therapist’s professional body.
    3. You may also inform us. However, given the confidential nature of therapy, we may be unable to take any action.
  12. Extra work
    1. You may not ask your Therapist to write reports or letters on your behalf, for example, if you are seeking damages in a legal claim and your Therapist’s opinion is important. This service may only be carried out if therapy takes place face to face.
  13. Limitation of liability
    1. You are solely responsible for creating and implementing your own physical, mental, and emotional well-being, decisions, choices, actions, and results arising out of or resulting from therapy Sessions. As such, you agree that neither we nor your Therapist are, and will not be, liable or responsible for any actions or inaction, or for any direct or indirect result of any instruction or suggestion provided by your Therapist.
    2. You acknowledge that therapy may touch upon many different areas of your life, including work, finances, health, relationships, education, and recreation. You agree that deciding how to handle issues and implementing choices is exclusively your responsibility.
    3. You understand that therapy does not prevent, cure, or treat any mental disorder or medical disease.
    4. You acknowledge that therapy does not involve the diagnosis or treatment of medical conditions and it is not to be used as a substitute for medical care.
    5. So as to gain the most benefit from a Session, you agree to communicate honestly to your Therapist, be open to feedback and assistance and to create the time and energy to participate fully.
    6. Except in the case of death or personal injury, the total liability of us or your Therapist to you under this agreement will not exceed the sum of the amount paid by you to us.
  14. Miscellaneous
    1. These terms form the entire agreement and supersede all previous agreements and understandings between us. So far as the law allows, all implied terms are excluded from this agreement.
    2. This agreement is governed by the laws of England and Wales.
